Employment Visa Process for Expats and People of Determination in the UAE | Freelance2Freedom

The Employment visa is applicable when any of the foreign national is employed in the UAE and the employer will be the sponsor in this regard.

1.    Job offer acceptance

The 'employer' will initiate the employment visa process for the 'employee' when a foreign national accepts a job offer in the country.

2.    Documentation

The employer will then gather documents from the employee and submit it to the government authority which is known as; the Ministry of Human Resources and Emiratisation (MOHRE). This will aid in the issuance of the employment visa for the employee.

The documents that are needed from the employee are as follows:

  • A copy of the employee's passport
  • A passport-size photo with a white background
  • The employment contract
  • Educational certificates
  • Tourist visa (if applicable)
  • Medical reports (if applicable)

These are the criteria that must be followed when submitting a passport-size photograph of the employee:

  • The photo must come with a white background. It must not have any shadow or pattern
  • The head must occupy 70% - 80% of the frame
  • You must not smile or frown too much and have a neutral facial expression
  • You should not wear any headgear except for any religious reason but it must not cast any shadow on your face
  • Eyeglasses should not be worn in the photo
  • Lighting must not cast any reflection or shadow
  • Employee's recent photo is to be given

These are the criteria that must be followed in case the employee is specially-abled:

  • If the employee has any health-relevant cases, then the employee is obliged to submit relevant medical reports to the employer along with the medical fitness certificate
  • The employer must ensure the workplace is 'people of determination' friendly
  • The employer must ensure there will be no discrimination taking place in the workplace
  • The employer must submit the supporting documents; 'The disability certificate' if applicable

3. Labour approval

The MOHRE will review all the document application and as an initial approval; they will issue a 'work permit'. This work permit will allow a foreign national to enter into the UAE on en employment visa.

4. Entry permit issuance

The General Directorate of Residency and Foreigners Affairs (GDRFA) will issue an entry permit upon receiving the labour approval. This permit will allow the employer to initiate the residency visa for the employee.

5. Medical examination

The employee undergoes a medical examination once he/she is in the UAE. This is to ensure that the employee is free from any communicable diseases. This is a compulsory step that every employee must go through.

6. Residency Visa stamping

When an employee passes his medical examination, The General Directorate of Residency and Foreigners Affairs (GDRFA) will then stamp a residency visa on the passport of the employee. This will allow the employee to stay for two years in the country.

7. Emirates ID application

Emirates ID is the UAE Government-issued identity card for the UAE's citizens and residents. It is compulsory to apply for an Emirates ID since this card is essential for opening a bank account, obtaining a driver's license or signing rental/leasing agreements.

8. Issuance of the labour card

After issuance of the residence visa and obtaining the Emirates ID, the employee receives a labour card. This is mandatorily given to employees whose employer's entities are subjected to Mainland rather than free zones.

Throughout this process, it is important that the employee and the employer remain vigilant about the legal requirements, and not fall short of in any administrative case. Securing a job in the UAE is half the battle, but ensuring the process meets legal standards is what completes it.
